...For the plaintiff The Court: Counsel for the petitioner is present. The petitioner has filed the present application for grant of Letters of Administration to the estate of the deceased Maitree Ghosh @ Maitreyi Ghosh. The deceased Maitreyi Ghosh left behind three legal heirs including the petitioner. After filing of this application, the petitioner has taken appropriate steps for issuance of general as well as special citation. Even after issuance of the general and special citation, none had appeared to raise their objection for grant of Letters of Administration to the petitioner.

The Registrar Insolvency, has filed a report wherein it reveals that the citations were issued but no caveat has been entered for grant of Letters of Administration.

Counsel for the petitioner submits that the testator died on 4th November, 2010.

Considered the prayer made by the learned Counsel for the petitioner, perused the death certificate and the report of the Registrar Insolvency, this Court finds that the petitioner has able to prove the case for grant of Letters of Administration.

In view of the above, prayer (d) of the PLA/56/2014 is allowed, subject to furnish security of Rs.1 lakh with one surety. Letters of Administration be issued upon compliance of all formalities.

PLA/56/2014 is thus disposed of.
