The Court: Mr. Paritosh Sinha, learned Counsel, is appearing for the plaintiff, Mr. Siddhartha Pratim Datta, Learned Counsel, is appearing for the respondents.

Mr. Shayak Mitra, learned Special Officer is also present. Learned Special Officer has filed the report after serving the copy to the learned Counsel for the respective parties. Let the same be kept with record. This Court has fixed the initial remuneration of Rs.50,000/-. Counsel for the plaintiff submits that the said remuneration has been paid.

As the Special Officer has submitted the report and the report is accepted, the plaintiff is directed to pay a further amount of Rs.25,000/- being the final remuneration within a week from date.

Counsel for the plaintiff has filed the Terms of Settlement stating that disputes between the plaintiff and the defendant has been settled and the settlement has been recorded in the Terms of Settlement dated 10th May, 2024. Counsel for the respective parties submits that on the basis of Terms of Settlement entered between the parties, the suit may be disposed of by making the Terms of Settlement as part of decree.

Considered the submission made by the Counsel for the respective parties. Perused the Terms of Settlement.

This Court finds that parties have settled their disputes and entered into the Terms of Settlement and there is no impediment to accept the Terms of Settlement entered between the parties.

Accordingly, CS-COM/654/2024 is disposed of in terms of Terms of Settlement entered between the parties dated 10th May, 2024. Decree be drawn up accordingly. The Terms of Settlement may be made as part of the decree.

As the parties have settled the disputes and the suit is disposed of, accordingly, issuance of writ of summons is not necessary. The Special Officer also filed the report by serving the copy to the learned Counsel for the respective parties. The Special Officer is discharged. (KRISHNA RAO, J.) Sbghosh
