...for KMC The Court: - The petitioner has preferred the present contempt petition alleging wilful disobedience of the order passed by this Court dated 7th August, 2025.

A perusal of the said order indicates that the Kolkata Municipal Corporation was directed to complete the process initiated under Section 401 of the KMC Act within a period of eight weeks strictly in accordance with law.

Learned Counsel for the Kolkata Municipal Corporation has handed over a copy of the order dated 18.05.2025 passed by the Executive Engineer (C)/(B)/ Borough - V, Building Department, KMC, which reflects that the respondent Kolkata Municipal Corporation has taken action in furtherance

of the directions passed by this Court and has proceeded in terms of Section 401 of the KMC Act by passing a demolition order dated 18.05.2025. Since the order passed by this Court has been duly complied with by the respondent corporation, nothing survives for adjudication in the present contempt petition.

It is further noted that the said demolition order has been challenged before the Municipal Building Tribunal and that the operation thereof has been stayed by the Municipal Building Tribunal. This Court is not called upon to examine the merits of the proceedings pending before the Municipal Building Tribunal. Since the order passed by this Court in WPA No. 368 of 2025 has been duly complied with, no case of wilful disobedience or contempt is made out against the respondent corporation. Accordingly, the contempt proceedings stand disposed of. (GAURANG KANTH, J.) gb.
