..for the respondents The Court: Affidavit of service is taken on record. The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award.

Learned Counsel for the petitioner, Mr. Banerjee, submits that a sole Arbitrator was appointed by this Court vide order dated 17.05.2023 to adjudicate the disputes between the parties. The pleadings were completed on 12.10.2023. With the consent of the parties, the mandate is extended by 6 months till 21.03.2025. Thereafter, vide order dated 03.03.2025 and 10.12.2025, the mandate of the arbitral tribunal was extended for a period of eight months and four months respectively. The last extension is expiring on 10.04.2026.

Learned Counsel for the respondent states that he has no objection to the extension of the mandate of the arbitral tribunal. Learned Counsel for the petitioner submits that the final arguments have already been concluded. The matter is presently at the stage of publication of the award.

Learned Counsel for the petitioner states that the learned Arbitrator is undergoing health issues and as such has been unable to publish the award within the extended time period. Being satisfied of the reasons given by the learned Counsel for the petitioner, this Court finds that there has been no undue and unwarranted delay on the part of the learned Arbitrator since her health condition is an impediment in publishing the award within the extended time period.

Having regard to the advanced stage of the proceedings and in the interest of justice, the mandate of the arbitral tribunal is extended further for a period of three months from today.

The learned sole arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.

With the aforesaid observations, the present petition stands disposed of.
