..for the Union of India The Court: Heard counsel appearing on behalf of the parties. The petitioner and the respondent have agreed to the following order being passed by this Court.

The respondent authority shall send ten names of retired officers of the railways to the petitioner herein who will choose three names for constitution of the Arbitral Tribunal. The three names chosen shall form the Arbitral Tribunal with the senior most member being the presiding Arbitrator.

The railways is directed to send the names within a period of three weeks from date and the petitioner should agree on the said names within a further period of two weeks.

It is to be noted that this arbitration is going on and the earlier Arbitrators are discharged. The Section 14 application is allowed as per the direction given above.

It is to be further noted that the pleadings are complete. The Arbitral Tribunal is, accordingly, directed to commence the arbitration from that point onwards.
