...for the respondent The Court: This is an application for termination of the mandate of the Arbitrator appointed by an order dated 31st July, 2019. Mr. Rudraman Bhattacharya, Advocate in his usual fairness submits that he wants to withdraw this application and to conclude the arbitration proceeding before the Learned Arbitrator.

By an order dated 1st October, 2021 the evidence on behalf of the petitioner's witness was closed. The order dated 1st October, 2021 is set aside.

The Arbitrator is directed to conclude the evidence of the witness without granting any unnecessary adjournments.

The petitioner undertakes not to keep any amount outstanding on account of remuneration of the Arbitrator for at least three sittings. The Arbitrator is also requested to conduct the arbitration proceeding as expeditiously as possible and also dispose of the application under Section 17 of the Arbitration and Conciliation Act, 1996 without any unnecessary adjournments.
