...for the respondents The Court:- At the outset, learned counsel for the petitioner seeks liberty, on instruction, to withdraw the present application and to start the proceeding afresh from the stage of invocation under Section 21 of the Arbitration and Conciliation Act, 1996.

Accordingly, AP/132/2023 is dismissed as withdrawn with liberty to the petitioner to commence the proceeding afresh from the stage of invocation under Section 21 of the 1996 Act, subject to the maintainability of the subsequent proceeding otherwise.
