The Court:- GA/5/2025 is filed praying for amendment of affidavit of assets. Attention of this Court is invited to a letter dated 21.10.2024 that the concerned bank did not allow access to the locker no.261A for which the claim is submitted.

The Will in respect of which probate was granted, contains that all other movable assets, gold ornaments and jewelleries and immovable properties would devolve on his son namely, Nilesh Harsukhlal Avalani. This application is filed by the wife of the said son.

Since he expired earlier on 5th May, 2021 and since the probate was granted in support of all the movable properties, access to the bank locker should be allowed by the concerned bank.

The petitioner personally has filed this application for amendment of affidavit of assets, which came to his knowledge later on, including the locker maintained in Central Bank of India, Camac Street Branch being locker no.261A.

Prayers (a) to (d) of the Master's Summons are accordingly allowed. The Department is directed to do the needful. GA/5/2025 stands disposed of.
