...for respondent The Court :- This intra-Court appeal by the department is directed against the order dated 8.4.2024 in WPO 269 of 2024. In the light of the order passed in CUSTA/34/2024 dated 10.4.2024 the order and direction issued by the learned Writ Court required to be interfered into since the matter has been remanded back to the Tribunal for a fresh decision.

Accordingly, the appeal is allowed and the order passed in the writ petition stands set aside.
