The Court:- A report has been filed by the engineers of the Kolkata Municipal Corporation wherein it has been mentioned that the petitioners were existing tenants of the ground floor of the premises no.171A, M.G. Road, Ward No.42, Borough-V of the Kolkata Municipal Corporation. They will be rehabilitated in the third floor as all existing tenants in the ground floor cannot be rehabilitated in the ground floor to accommodate all the tenants as per the sanctioned plan.

As the petitioners have been earmarked to be rehabilitated in the third floor of the new construction that is coming up, accordingly, no further order is required to be passed in the instant writ petition and the same stands disposed of.

Copy of the instruction by the engineers has been circulated amongst the learned advocates representing all the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all legal formalities. (AMRITA SINHA, J.) nm
