The Court :- The Special Citation sent to Krishna Bhadury one of the heiress in intestacy of the deceased/testatrix has come back with the postal endorsement "Not Claimed". The gist of the General Citation has been published in the newspaper. It was published once in "Anandabazar Patrika" dated 10th April, 2022 and "Times of India" Calcutta edition also dated 10th April, 2022 as will appear from the newspapers forming part of the affidavit which is on record. The affixation as directed has also been done. There is no intimation of filing of testamentary caveat by the other heirs/heiresses pursuant to service of the citation.

Considering these facts, probate is granted in terms of prayer (a) of the application being PLA 222 of 2021 to the applicant. The application for grant of probate being PLA 222 of 2021 is accordingly disposed of.
