The arbitration agreement is in the form of partnership deed dated 2nd November, 1999.

Learned counsel for the respondent has submitted that the dispute is in respect of induction of the applicant in the partnership after the death of her husband, Santi Ranjan Sengupta, who was one of the partner in the firm. On instruction, learned counsel for the respondent has submitted that the respondent has no objection in taking the applicant in the partnership and, therefore, now the dispute no longer survives. Learned counsel for the applicant has also readily accepted the offer and has fairly submitted that now the dispute between the parties does not survive.
