In this matter petitioner has challenged the impugned order of rejection dated 13th March, 2020 of the application of the petitioner for treating the petitioner not in default during the pendency of the appeal filed against the assessment order in question. Petitioner submits that appeal before the CIT (appeal) was filed on 27th February, 2020. Considering the submission of the petitioner I am of the view that there is no use of keeping this writ petition pending and this writ petition can be disposed of by directing the CIT (appeal) concerned to dispose of the pending appeal in question within two months from the

date of communication of this order by giving opportunity of hearing to the petitioner or its authorised representative. With these directions and observations, this writ petition being WPO 365 of 2020 is disposed of.
