The Court: Affidavit of service filed in Court is taken on record. IA GA-COM 2 of 2026 is an application for recall of the order dated June 9, 2025 subsequently modified on February 3, 2026. It is submitted by the petitioner that matter has been settled out of Court and the order should be recalled.

In my view, the appointment of the arbitrator was made prior to settlement of the matter between the parties. There is no requirement to recall the order which was passed at the instance of the petitioner. Upon settlement of dues the claims of the petitioner have been met and as such the order passed by this Court need not be implemented.

The application is accordingly disposed of.
