...for K.M.C The Court : The grievance of the petitioner is directed against the refusal of the respondent Corporation to implement an order dated 14th December, 2012 directing demolition of the subject premises. The matter has been heard on diverse occasions and several orders have been passed from time to time. Pursuant to an earlier direction dated 24th February, 2021 a report is filed on behalf of the respondent Corporation. The report has been signed by the Director General, Building, Kolkata Municipal Corporation. It appears from the report that the concerned officer of the Kolkata Municipal Corporation has
unequivocally stated that the demolition work at a portion on second floor level of the building and premises no. 12, Malanga Lane, Kolkata-700012 has been carried out in terms of the orders of Court and the demolition order dated 14th December, 2012 passed by the Kolkata Municipal Corporation. In view of the orders which have been passed from time to time and in the light of the reports filed by the Director General, Building and the Deputy Chief Engineer Building in Court, I am of the view that there is no scope for passing any further orders in this petition. The respondent Kolkata Municipal Corporation is directed to hand over a copy of the reports filed in Court today on the petitioner.
The petitioner is granted liberty to take necessary steps in accordance with law if so advised.
The State respondents are represented.
In view of the aforesaid, nothing survives in this writ petition. WP 194 of 2018 stands disposed of.
The personal presence of Mr. Prasun Roy of the Kolkata Municipal Corporation is noted and dispensed with.
