The Court: This is an application under Section 14 of the Arbitration and Conciliation Act, 1996, inter alia, seeking termination of the mandate of the Arbitrator. By an order dated 21 April, 2023, a Co-ordinate Bench had appointed a Junior Member of Bar as Sole-Arbitrator in terms of the arbitration clause. It is contended that due to ill-health and on personal grounds, the Arbitrator is unable to continue to act as Arbitrator. In such circumstances, there shall be an order in terms of prayer (a) of the Notice of Motion.

Mrs. Suchismita Ghosh Chatterjee, a member of the Bar Library Club is appointed as a substitute Arbitrator by consent of the parties subject to communicating her consent to the Registrar, Original Side of this Court within three weeks from date.

With the aforesaid directions, AP/79/2024 stands disposed of. The order dated 21st April, 2023 stands modified to the above extent only. (RAVI KRISHAN KAPUR, J.) SK.
