...for respondent The Court:- The petitioner has preferred the present petition under Section 14 of the Arbitration and Conciliation Act, 1996 seeking termination of the mandate of the sole Arbitrator appointed through Webnyay ADR Institution and for appointment of a substitute Arbitrator. Learned Counsel appearing for the respondent at the threshold states that the Arbitrator appointed by the Webnyay ADR Institution can be substituted and a new Arbitrator may be appointed. In view of the statement and with the consent of the learned Counsel for the parties, this Court appoints Mr. Balarko Sen, Advocate (Mob. 9830449933) as the sole Arbitrator to adjudicate the disputes between the parties.

The learned Arbitrator shall be at liberty to fix his remuneration in terms of the fourth Schedule of the Act. The learned Arbitrator shall enter

upon reference upon making disclosure in compliance with Section 12 of the Arbitration and Conciliation Act.

Needless to state, all proceedings arising out of the arbitration proceedings initiated before the earlier learned sole Arbitrator stand quashed.

Since the affidavits have not been called for, none of the allegations are deemed to have been admitted.

All questions relating to arbitrbility of the dispute, admissibility of the claims, limitation and other issues are kept open to be urged before this learned Sole Arbitrator.

With the aforesaid directions, the present petition stands disposed of. (GAURANG KANTH, J.) gb.
