1. This is an application for appointment of a learned substitute arbitrator in place of the learned erstwhile arbitrator who has since been elevated as a Judge of this Hon'ble Court. The erstwhile learned Arbitrator is unable to perform his duties on account of His Lordship's elevation. The application is allowed.

2. Accordingly, the Court appoints Mr. Suman Kumar Dutt, learned Senior Advocate (Mob. No.9830403181), as the substitute Arbitrator. The parties are at liberty to approach His Lordship's office for return of all documents, pleadings, evidence etc. pertaining to the proceedings. The learned Arbitrator shall continue from the stage the proceedings were

last held. The appointment is subject to compliance of Section 12 of the Arbitration and Conciliation Act, 1996. The learned Arbitrator shall fix his own remuneration as per the Schedule of the Act. The learned Arbitrator will make and publish his award within a year.
