Complaining inaction on the part of the municipality to proceed against the unauthorised construction in relation to the premises no.X-15, Akra Road, presently S. A. Farooque Road, P.S. - Nadial, Kolkata - 700018, under Borough - XV of the Kolkata Municipal Corporation in terms of the order dated 13th April 2023 passed by a coordinate Bench of this Court in WPA 2997 of 2023, the instant writ petition has been filed.

The learned advocates for the petitioner and the private respondents would jointly submit that a hearing has already been conducted in connection with the proceeding initiated by the municipality, though

the outcome thereof has not been intimated to the parties. Mr. Ghosh, learned advocate appears for the municipality. 3.

Having heard the learned advocates representing the respective parties and noting that the parties were heard in connection with the proceedings initiated by the municipal authorities, I am of the view that the outcome thereof must be communicated to the parties. 4.

It is made clear that if no decision has been taken by the municipal authorities as yet, the concerned officer upon giving a further opportunity of hearing to the parties shall conclude the same in accordance with law. Till such time a decision is taken in terms of the order passed by the coordinate Bench of this Court on 13th April 2023 and communicated to the parties, the Officer-in-Charge, Nadial Police Station shall ensure that no construction of any sort and in any manner whatsoever is permitted to be carried out at the said premises.

The writ petition thus stands disposed of.
