The Court: The petitioner in the present writ petition, challenges the Annual Value Determination carried out by the respondent Municipality in respect of premises No. 2, Hem Chandra Naskar Road, Police Station Beliaghata, Kolkata-700010, with effect from the 4th quarter of 2016 to the 1st quarter of 2017.

Learned counsel for the petitioner submits thatthe petitioner has admitted liability in respect of the principal amount of the property tax and has already made representations dated 27.01.2025 and 06.02.2025 before the respondent Municipality, seeking waiver of the interest and penalty levied thereon.

Learned counsel for the respondent Corporation states that they are ready and willing to consider the petitioner's representations dated

27.01.2025 and 06.02.2025, but only to the limited extent of deciding the issue of interest and penalty on the assessed property tax. Learned counsel for the petitioner further submits that he shall be satisfied if the said representations are decided, to the limited extent enumerated therein, within a time-bound manner. In view of the submissions made by the Counsel for the parties, this Court directs respondent no. 3, the Chief Manager (Revenue) (North), Kolkata Municipal Corporation, to consider and decide the petitioner's representations dated 27.01.2025 and 06.02.2025, to the limited extent stated therein, within a period of four weeks, strictly in accordance with law, and after affording an opportunity of personal hearing to the petitioner as well as the private respondents, by passing a reasoned and speaking order.
