...for the respondents The Court: Learned counsel for the petitioner, in his usual fairness, submits that during the pendency of the writ petition, the cause of action on which the writ petition was taken out has become infructuous in view of a communication by the respondent authorities to the petitioner that the petitioner has been permitted to participate in the impugned tender. However, learned counsel submits that due to the dearth of information with regard to the tender and paucity of time, the petitioner is not in a position to submit his bid immediately. For such purpose, the respondents be directed to

serve relevant copies of the notice inviting tender and grant some time to the petitioner to submit the petitioner's bid.

Learned counsel for the respondent authorities also, in his usual graciousness, accepts such submission as reasonable. In such view of the matter, WPO/666/2023 is disposed of by directing the respondent authorities to serve on the petitioner a copy of the entire tender document along with conditions on the petitioner as well as other necessary documents within June 12, 2023.

The petitioner shall, thereafter, latest by June 20, 2023 submit the petitioner's bid with the respondent authorities. If the bid is so submitted, the respondent authorities shall proceed on the premise that the petitioner is a valid participant in the tender process and shall carry along with the tender process in accordance with law.

A copy of the communication given to the petitioner, handed over in court today, be kept on record.
