The Court: Supplementary affidavit filed in Court be taken on record. After certain arguments made before this Court, the Court has suggested that the best course of action would be that the Court appoints an independent Arbitrator keeping in mind the Supreme Court judgment reported in 2019 SCC Online SC 1517 (Perkins Eastman Architects DPC vs. HSCC (India) Limited). The parties have also agreed to the same to facilitate progress in this matter and left the decision of the Arbitrator on this Court. In view of the above, Mr. Reetobroto Mitra, Advocate, is appointed as Arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

AP/102/2022 is, accordingly, disposed of.
