Mr. Emon Bhattacharya, Adv. ...for petitioner. The Court :- This is an application for extension of the mandate of the learned Arbitrator.

None appears on behalf of the respondent, despite service. This court has jurisdiction to entertain this application. It is submitted by the learned advocate appearing for the petitioner that, the erstwhile learned advocate for the respondent was contacted, who claimed to have retired from the brief.

The attention of the court is drawn to an application filed by the respondents praying for dismissal of the claim. The petitioner wants to pursue the matter before the learned Arbitrator, as the counter claim is yet to be adjudicated. The application for dismissal of the claim filed by the respondents has been dismissed. The mandate of the learned Arbitrator expired sometime in the month of March, 2025. The counter claim of the petitioner is required to be heard, even if the respondents/claimants do not want to proceed with the claim.

Under such circumstances, the mandate of the learned Arbitrator is extended for a further period of six months from the date of communication of this order, within which time the learned Arbitrator shall make and publish the award.
