The Court :- Affidavit of service filed in court today be taken on record.

Ms. Brinda Sengupta, learned advocate for the petitioner submits that the tenant namely, the Income Tax Department and the Central Excise Department have already vacated the premises. However, it has been intimated by the Receiver that, certain amounts against the rent received from the tenant is lying with the Receiver. Since no steps were taken and the plaintiff was not represented, the suit was dismissed for default on 22.11.2022. She seeks for appropriate orders for discharge of the Receiver after making over the proceeds thereof to the petitioner upon deducting his remuneration. Learned advocate for the petitioner is directed to serve the copy of this application to the office of the learned Additional Solicitor General.

The learned Registrar, Original Side, is directed to furnish a report with regard to the amounts lying in the accounts of the Receiver by the next date fixed.

List the matter on 1st April, 2025.
