2. Despite service the respondents are not represented.

3. The petitioner claims to be the owner in respect of the premises no. 2/2, Madhab Sett Lane, Police Station-Posta, Kolkata-700007. The petitioner also claims that the said premises was acquired by the petitioner by virtue of a registered deed of conveyance duly executed and registered in the year 2025. Immediately upon purchasing the property, petitioner made a representation regarding the property in question being dilapidated. No disclosure has been made as to whether the petitioner while purchasing the property was aware as regards the condition of the building, although the learned Advocate for the

WPO/231/2026 petitioner would submit that there are three tenants, such tenants are not parties to the instant proceeding.

4. At this stage, the learned Advocate for the petitioner seeks leave to withdraw the writ petition by reason of the formal defects in not incorporating the tenants as parties.

5. Accordingly, the instant writ petition is dismissed as withdrawn with liberty to file afresh on the self-same cause of action. (RAJA BASU CHOWDHURY, J.) S.Seal
