Mr. Moti Sagar Tiwari, Learned Counsel, is appearing for the plaintiff.

Though the matter is fixed today for presentation of plaint, counsel for the plaintiff has prayed for leaver under Clause 12A of the Letters Patent but the learned Counsel for the plaintiff submits that he will withdraw the suit and he will take appropriate steps for initiation of pre-mediation process. Accordingly, he prays for withdrawal of the suit.

In view of the submission made by the counsel for the plaintiff, CSCOM/62/2025 is dismissed as withdrawn with liberty to the plaintiff to approach for pre-mediation process.

Counsel for the plaintiff submits that the plaintiff has paid the Court fee and he prays for refund of Court fee.

In view of the submission made by the counsel for the plaintiff, the department is directed to refund the Court fee to the plaintiff and the

plaintiff is at liberty to use the said Court fee to file a fresh suit, if any, after the pre-mediation process.
