The Court :- Let affidavit filed by the Executive Engineer [Building Department], Borough-IV be kept with the records. By filing this writ petition the petitioners allege unauthorized construction at the behest of the respondent no.6 at premises no.24A, Vivekananda Road, Kolkata 700007.

Mr. Ghosh, learned Advocate representing the Kolkata Municipal Corporation submits that the Corporation had issued a notice under section 400[1] of the KMC Act, 1980. The matter was subsequently referred to the Heritage Conservation Committee of the Corporation since the relevant property features in the Heritage list of the Corporation. Mr. Ghosh further submits that the matter will be dealt with immediately after receipt of the report from the Heritage Conservation Committee.

In that view of the matter, I do not find any reason to keep this writ petition pending. Accordingly, I dispose of the writ petition by giving a direction upon the Corporation to complete the entire proceeding within a period of six months from date after giving an opportunity of hearing to the petitioners as well as respondent no.6.

Accordingly, the writ petition, WPO/434/2024 is disposed of. (KAUSIK CHANDA, J.) Nm.
