...for the defendant The Court:- By consent of parties C.S. No. 54 of 2022 (Ankar Industries Private Ltd. Vs. Apeejay Tea Ltd.) be treated on the Day's list. Both the suit and the application are disposed of by the following order: (a) Service of writ of summons and all formalities to make the suit ready for hearing are waived by the defendant.

(b) There will be a decree for Rs.71,52,469.64 in favour of the plaintiff and against the defendant.

(c)The defendant is directed to pay the decretal amount of Rs.71,52,469.64 to the plaintiff in 7 monthly instalments commencing from 4th May, 2022 and to be paid in full by 4th November, 2022 in the following manner:

(i) Rs. 11,52,469.64 within 4th May, 2022

(ii) Rs. 10,00,000.00 within 4th June, 2022 (iii) Rs. 10,00,000.00 within 4th July, 2022 (iv) Rs. 10,00,000.00 within 4th August, 2022 (v) Rs. 10,00,000.00 within 4th September, 2022 (vi) Rs. 10,00,000.00 within 4th October, 2022 (vii) Rs. 10,00,000.00 within 4th November, 2022 (d) The defendant is directed to pay a lump sum of Rs.60,000/- as interest on the said sum of Rs.71,52,469.64.

(e) The parties will bear their own costs of the suit In view of the aforesaid, GA/1/2022 and CS/54/2022 are disposed of. (f) The Department is directed to expeditiously draw up the decree. (RAVI KRISHAN KAPUR, J.) TO
