Learned counsel for the petitioner agrees that the matter should be taken up in the Appellate Side.

Accordingly, let the matter be sent back to the Department so that the same may be converted into a petition in the Appellate Side and necessary corrections and amendments be done like renumbering the petition. On the joint prayer of the learned counsels for the parties, let this matter appear in the list one week after the ensuing Puja vacation.
