The Court:- This is an application under Section 9 of the Arbitration and Conciliation Act, 1996. By an order dated 17th November, 2021, this Court had passed an order in terms of prayer (a) of the petition. It is submitted on behalf of the parties that the Receiver is in actual possession of the subject asset. In view of the aforesaid, AP No. 365 of 2021 is disposed of by granting liberty to the petitioner to take appropriate steps, if so advised including steps for sale of the subject asset before the Arbitrator, in accordance with law. Notwithstanding efforts, the parties were unable to agree on a named Arbitrator.
