...for respondent no.11 The Court: The petitioners pray for consideration of the representation that has been filed on 13th October, 2023. The petitioners intend to raise a new construction by demolishing the existing one which is in a dilapidated condition. The petitioners assert that all documents required for grant of sanction have been forwarded along with the aforesaid representation. The Howrah Municipal Corporation is yet to take a decision on the same.

The petitioners submit that steps have been taken to ensure that no pollution takes place at the time of raising the construction. Learned Advocate representing the Corporation submits, upon instruction that, steps will be taken to consider the request made by the petitioners. Without entering into the merits of the claim of the petitioners, the instant writ petition is disposed of by directing the Commissioner, Howrah Municipal Corporation or his delegate to consider the representation received in the office of the Howrah Municipal Corporation on 13th October, 2023 in accordance with law after giving reasonable opportunity of hearing to the necessary parties for production of documents and to dispose the same by passing a reasoned order at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate for the petitioners is directed to forward a copy of representation dated 13th October, 2023 along with all documents in support of the prayer made to the aforesaid respondent at the time of communicating the order of the Court.
