Two sets of pleadings have been filed for the purpose of being kept on record since the original file was not traceable. Mr. Mitra, learned senior counsel representing the petitioners, says that the order of the bank whereby the name of the petitioner No.1 was included in the list of wilful defaulters in the records of the

Reserve Bank of India, has been quashed by a learned Single Judge of this Court by an order dated April 10, passed in WPA/26208/2017. However, the respondent Bank is still not removing the name of the petitioner company from the list of wilful defaulters in the records of the Reserve Bank of India. The bank has said that it will do so subject to the petitioners withdrawing all pending proceedings including the present contempt application. Under those circumstances, the petitioners pray for leave to withdraw this contempt application so that the respondent Bank can give effect to the assurance that it will remove the name of the petitioner company from the list of wilful defaulters in the records of the Reserve Bank of India.

Written instructions filed by the learned advocate for the petitioner No.1 is kept with the records.

CC No.40/2016 is disposed of accordingly.
