In the meantime, the award-holder is directed to serve a notice on the judgment-debtor and file an Affidavit of Service on the returnable date. It is submitted that no application under Section 36(2) of the Arbitration and Conciliation Act, 1996 has been filed and the award-holder is at liberty to proceed of this execution application. The time to file the Affidavit of Assets in terms of the earlier orders of Court stands extended till 30th September, 2023. It is made clear that in default of filing of Affidavit of Assets, appropriate orders for warrant of arrest would be passed against the judgment-debtor.
