The Court : This application under Section 11 of the Arbitration and Conciliation Act, 1996 has been filed for appointment of an arbitrator to resolve the disputes between the parties.

Heard learned counsel appearing on behalf of the parties. In my view, an Arbitrator is required to be appointed in this matter. The parties have left the decision of appointment of an Arbitrator upon this Court and have agreed to go for arbitration.

In light of the above submissions made by the Counsel, Mr. Ayan Banerjee, Advocate (Mobile No.9830916210) is appointed as Arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

Since no affidavit is called for, the allegations made in the petition are deemed to have been denied.

Leave is granted to the learned advocate for the respondent to file Vakalatnama within seven days from date.
