The Court: Mr. Victor Dutta, learned counsel representing the appellant, submits that that during the pendency of the appeal, the borrower had repayed the loan and as such the appellant has no further claim against the respondents.

In view of such changed circumstances, the appeal stands disposed of along with the pending application by recording that the appellant has received its entire debts in the meantime from the respondent no.4.
