...for Union of India The Court: Heard learned advocates appearing for the parties. Petitioner has filed this writ petition being aggrieved by the action of the respondent Authority concerned refusing the petitioner its claim of interest on delayed refund.

Mr. Kundalia, learned advocate appearing for the respondent Customs Authority opposes this writ petition by contending that the respondent Authority concerned has already taken a decision disclosing the reason for not granting the interest in question and such decision has not been challenged by the petitioner and as such no relief can be granted to the petitioner.

Learned advocate appearing for the petitioner prays for liberty to withdraw and file a fresh writ petition and considering his such prayer this writ petition being WPO 819 of 2023 is dismissed as withdrawn with liberty to file fresh writ petition.
