The Court : Learned counsel for the parties submit that the learned Arbitrator appointed vide order dated June 28, 2024 has recused at the outset in view of his other engagements.

Accordingly, on the prayer of the parties, a fresh appointment is required to be made. Hence, Justice Indira Banerjee, a retired Judge of the Supreme Court of India, is appointed as the learned Arbitrator to resolve the disputes between the parties, subject to a declaration being obtained from the learned Arbitrator in terms of Section 12 of the Arbitration & Conciliation Act, 1996. The learned Arbitrator shall fix her own remuneration in consonance with the provisions of the 1996 Act as well as Schedule IV thereto. (SABYASACHI BHATTACHARYYA, J.) s.pal
