...for the respondent The Court: Learned counsel for the parties submit before this Court that during pendency of the present challenge under Section 34 of the Arbitration and Conciliation Act, 1996 arising out of an arbitration under the Micro, Small and Medium Enterprises Development Act, 2006, the parties have resolved the matter among themselves. The terms of settlement have been annexed at page 27 to GA/2/2024 (as Annexure F to the same). Accordingly, on the prayer of the parties, AP/457/2017, along with GA/2/2024, are disposed of in terms of the settlement arrived at by the parties as enumerated in Annexure F at page 27 of GA/2/2024.

Let the said terms of settlement be deemed to be a part of the present order.

Accordingly, in terms of prayer (i) of GA/2/2024, the learned Registrar, Original Side of this Hon'ble Court is directed to encash the Fixed Deposit to the credit of the matter maintained with the Central Bank of India, Red Cross Place Branch, and is further directed to pay to the petitioner the entire amount so encashed in its bank account bearing No. 10660310000040, maintained with the HDFC Bank, 105, S.N.P Area, Main Road, District - Purbi Singhbhum, Jamshedpur-831 001, Jharkhand (IFSC: HDFC0001066) after deducting the necessary charges. No order as to costs.
