The Court: It is submitted on behalf of the petitioner that pursuant to the filing of this application an Arbitrator has been appointed and the arbitral proceedings have commenced.

In view of the submissions made on behalf of the petitioner no purpose would be served in keeping this application pending. Accordingly, AP/430/2020 is dismissed as withdrawn.

However, the Receiver appointed pursuant to the order dated 11th January, 2021 be directed to continue in possession subject to further orders passed by the Arbitral Tribunal.

The respondent is represented and submits that the Arbitral Tribunal has no jurisdiction in this matter. This submission is disputed by the petitioner. (RAVI KRISHAN KAPUR, J.) TO
