The Court: This application under Clause 13 of the Letters Patent, 1865 read with Section 24 of the Code of Civil Procedure, 1908 is taken up for hearing. Heard the learned counsels appearing for the parties. Vide the application, the petitioner herein has prayed for transfer of Title Suit No.1154 of 2022 (Aryan Dhatu Pvt. Ltd. vs. Entertainment Unlimited & Ors.) pending before the Court of the learned 1st Civil Judge (Sr. Division), at Barasat 24 Pgs (North) to this Hon'ble Court for expeditious disposal of the same. Placing reliance upon paragraph 4 of the application, learned counsel for the petitioner submits that the petitioner's application filed in April, 2025 has not been disposed of till date. It appears that after filing of the said application, the

petitioner approached the High Court within 20 days and did not give any opportunity to the Trial Court to even decide the application. From the materials on record, it appears that the grounds required for allowing such prayer for transfer is not available. Considering all these facts, the application is disposed of with a direction that the Trial Court shall make all endeavour to dispose of the application dated 30th April, 2025 within 60 days from the date of communication of this order and make all endeavour to dispose of the suit expeditiously, preferably within one year from the date of this order. Since no affidavits have been called for, the statements made in the application, are deemed to have been denied by the respondents. (SHAMPA DUTT (PAUL), J.) A.Sadhukhan
