The Court:- Learned counsel for the respondent has submitted that the respondent is under Corporate Insolvency Resolution Process and by the order of the NCLT, Kolkata Bench dated 25th May 2022, moratorium under Section 14 of the IBC has been declared.

In the aforesaid circumstances, learned counsel for the applicant seeks permission to withdraw this AP with liberty to approach this Court in case the need so arises.

The prayer is allowed. AP is dismissed as withdrawn with the liberty as prayed.
