The Court: There is a mistake in recording the submission of learned counsel for the appellant in our order dated 15th January, 2024 as pointed out by Mr. Tilak Bose, learned senior counsel appearing for the appellant. The fact is that during the pendency of the appeal, the respondent died without any right surviving in the applicant against his heirs. In those circumstances, the appeal abated.

Therefore, the order dated 15th January, 2024 be corrected by replacing 'desirous of proceeding' by 'required to proceed' and 'application' should be followed by 'as the respondent has expired and the application has abated'. (I. P. MUKERJI, J.) (BISWAROOP CHOWDHURY, J.) Cs.
