Mr. Joy Saha, Sr. Adv.; Mr. S. Sen, Adv.; Mr. A. banerjee, Adv., for respondents. THE COURT: In the appeal bearing APO/32/2022, the writ petitioner has challenged the order of the learned Single Judge, dated 19th January, 2022, dismissing WPO/419/2022.

Learned counsel for the respondents has informed that after the order of the learned Single Judge, a fresh auction has taken place and the successful bidder has been identified.

In view of the subsequent development, the learned counsel for the appellant seeks permission to withdraw APO/32/2022 with liberty to take

appropriate steps for claiming damages or to file other remedies. His limited prayer at this stage is that the respondents may supply the details of the successful bidder in the fresh auction who has now been identified. If such an application is made by the appellant, the details relating to the successful bidder identified in the fresh auction will be supplied by the respondents to the appellant in accordance with law expeditiously. Needless to say, we have not gone into the merits of the matter. With the aforesaid, APO/32/2022 is disposed of as withdrawn with the liberty as prayed.

In view of the above order passed in APO/32/2022, learned counsel for the appellant in MAT/345/2022 also seeks permission to withdraw MAT/345/2022.

His prayer is allowed. MAT/345/2022 also stands disposed of as withdrawn.
