By an order dated 9th January, 2024 on the prayer made by the Counsel for the plaintiff, the name of the defendant Nos. 1 and 2 have been deleted and the plaintiff is given liberty to re-affirm and re-verify the affidavit. Though the department has carried out the order dated 9th January, 2024 by recording the death of defendant Nos. 1 and 2 but the plaintiff has not taken any steps to re-verify and re-affirm the affidavit after the amendment. Today when the matter is called, none appears on behalf of the plaintiff. Accordingly, CS/79/2015 is dismissed for default. Interim order, if any, stands vacated.
