The Court:- The direction passed by this Court appears to have been partially complied with by the alleged contemnor. Admittedly there is delay in complying the direction passed by this Court. The learned Advocate appearing on behalf of the Kolkata Municipal Corporation submits that the delay primarily occurred due to the pandemic situation where the staff and officers of the Corporation were not readily available.

As regards the consideration of the application of the petitioner for apportionment of taxes it has been submitted by the learned advocate representing the Corporation that on 10th February, 2022 the petitioner has filed an application in the prescribed format for apportionment of taxes.

It appears from the submission of the petitioner that the inspection report which has been prepared by the Corporation was already under challenge in subsequent writ petition being WPO No. 1150 of 2021. In view of the above, the Court is of the opinion that no further order is required to be passed in the instant contempt application, save and except, the Corporation shall take steps for consideration of the application of the petitioner for apportionment of taxes as directed in the order dated 13th April, 2021. CC No. 48 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
