The Court:- It is submitted on behalf of both the parties that during the pendency of this proceeding, the respondent has taken steps to withdraw the impugned mark as well as close its business pertaining to manufacture of the impugned product. The letter dated 23 June, 2023 issued by the respondent seeking withdrawal of the impugned mark is also placed on record.

The respondent is represented and does not object to the submission. In view of the above, nothing survives in this application, IPDATM/171/2023 stands disposed of as infructuous. The Registry is directed to take necessary steps for rectification of the Register for removal of the impugned mark.
