The Court:- This is an application under Section 29(A) of the Arbitration and Conciliation Act, 1996. The petitioner seeks an order extending the mandate of the sole Arbitrator to conclude the proceedings. It is submitted on behalf of the petitioner that proceedings are at an advance stage and only final arguments are left to be concluded. The respondents Railway is represented and does not object to the prayer for extension of the mandate of the Arbitrator.

In view of the fact that the arbitration proceedings are at an advanced stage, I am of the view that it would be appropriate to extend the time for the learned Arbitrator to make and publish the Award. The time to publish the Award is extended by a period of three months from date.

It is made clear that the order is peremptory and no further extension would be granted to the Arbitrator.

In view of the aforesaid, AP No.383 of 2021 stands disposed of. (RAVI KRISHAN KAPUR, J.) D.Ghosh
