The Court: By consent of the parties, prayer (a) of the Notice of Motion stands corrected to reflect the correct AP No i.e., AP/484/2017 instead of AP/484/2015.

This is an application for recording a Terms of Settlement entered into by and between the parties.

Briefly, being aggrieved by an award dated 23 March, 2017 passed by the Sole Arbitrator, the petitioner had filed this application under Section 34 of the Arbitration and Conciliation Act, 1996 (the Act). During the pendency of the proceedings, both the parties have entered into terms of settlement and executed a formal Terms of Settlement which is annexed to the application. The Terms of Settlement has been duly signed by both the parties and their respective Advocates.

I have considered the Terms of Settlement and the same appears to be lawful and proper.

In such circumstances, there shall be an order in terms of prayer (a) of the Notice of Motion.

With the aforesaid directions, GA/1/2024 stands disposed of. In view of the aforesaid, nothing survives in AP/484/2017 and the same stands disposed of.
