The Court: The respondent is represented and submits that in view of the grievance of the petitioner raised in this suit, the respondent has changed the impugned mark and trade dress and has commenced business activities under the name of "Igenuity" and undertakes not use the impugned mark or name. The respondent undertakes not to use the impugned trade dress nor the impugned mark.
