The Court:- Learned Advocate for the plaintiff is present. It appears from the order dated 20th March, 2025 that there was a direction upon the Registry to furnish a report. Learned Advocate for the plaintiff submits that he has instructions to withdraw the suit as because no amount is due and payable by the defendant. Learned Advocate also furnishes a copy of the letter dated 29th April, 2024 issued by Dr. Rishikesh Rai, Secretary (I/c), Tea Board, India. In terms of the letter dated 29th April, 2024 and in view of the submissions made by Mr. Sarkar, learned Advocate for the plaintiff that there is no amount due payable by the defendant to the plaintiff, this Court is of the view that the suit has become infructuous and the same should be dismissed and as the plaintiff has prayed for withdrawal of the suit, the said permission should be granted. Thus, the suit is dismissed as withdrawn.
